1. Description of Service VirtualCloset is a personal digital wardrobe organization tool designed to help users manage, categorize, and create outfits from their existing clothing items. The Service is provided solely for Private, Personal, and Non-Commercial Use only.
2. User Content and Copyright (Intellectual Property) A. Ownership of User Content VirtualCloset claims NO ownership over the images, photos, metadata (brand, price, category), or other content that you upload, link, or otherwise make available through the Service (collectively, "User Content"). You retain all ownership rights to your User Content. By uploading User Content, you grant VirtualCloset a non-exclusive, worldwide, royalty-free, and transferable license to use, display, reproduce, and distribute the User Content solely for the purpose of operating and providing the Service to you. This license ends when you delete your User Content or your account.
B. User Warranties and Rights You represent and warrant that: - You are the creator and owner of the User Content, or you have the necessary licenses, rights, consents, and permissions to use and to authorize the Service to use and distribute your User Content as necessary to exercise the licenses granted by you in these Terms. - The User Content you upload, including images imported from third-party retailers (e.g., Vinted, Zara, ASOS) via URL, is for your personal inventory tracking only and does not infringe upon, misappropriate, or violate a third party's patent, copyright, trademark, trade secret, moral rights, or other proprietary or intellectual property rights, or rights of publicity or privacy.
C. Prohibited Use You must not use the Service to upload, link, or share content that is illegal, defamatory, obscene, or that promotes illegal acts. Any use of the Service for commercial purposes, including the resale or redistribution of User Content, is strictly prohibited.
D. Hold Harmless and Indemnification You agree to indemnify and hold harmless VirtualCloset, its affiliates, developers, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with any actual or alleged copyright infringement or violation of any third-party intellectual property rights related to the User Content you upload or import into the Service.
3. Disclaimer of Warranties (AS-IS Service Provision) THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Without limiting the foregoing, we explicitly disclaim all warranties of fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
Data Security Disclaimer We do not guarantee that the Service will be uninterrupted, secure, or error-free. You acknowledge that electronic storage and transmission of data may be subject to security breaches. In the event of a system failure, database crash, or any loss of your User Content or data, VirtualCloset and its developer shall not be liable for any resulting damages, loss of business, or loss of information. You are responsible for maintaining copies of your essential data outside the Service.
4. Termination We may terminate or suspend your account access immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. We reserve the right to ban users who are found to be repeatedly infringing the copyrights of others or who otherwise abuse the Service. Upon termination for any reason, your right to use the Service will immediately cease, and your data may be permanently deleted.
5. Governing Law These Terms shall be governed and construed in accordance with the laws of Portugal and the European Union (EU), without regard to its conflict of law provisions.
